Mr. Nicolas REMY has established this Privacy Policy, the purpose of which is to provide users of the website hosted at the following address: jacquesremy.com (the Site) with transparent information about how personal data is collected and processed by Jacques Remy & Fils.

The term “User” refers to any user, whether a natural or legal person, who visits or interacts in any way with the Site.

As such, Jacques Remy & Fils determines all technical, legal, and organizational means and purposes for processing Users’ personal data. Jacques Remy & Fils undertakes to take all necessary measures to ensure that personal data is processed in accordance with the law of July 30, 2018, on the protection of individuals with regard to the processing of personal data (hereinafter, “the Law”) and the European Regulation of April 26, 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (GDPR) (hereinafter the “Regulation”).

Jacques Remy & Fils is free to choose any natural or legal person who processes users’ personal data at its request and on its behalf (hereinafter the “Processor”). Where applicable, Jacques Remy & Fils undertakes to select a Processor offering sufficient guarantees with regard to the technical and organizational security measures for the processing of personal data, in accordance with the Law and the Regulation.

Processing of personal data

The use of the Website by Users may result in the communication of personal data. The processing of this data by REMY Nicolas, in its capacity as Data Controller, or by service providers acting on behalf of Jacques Remy & Fils, will comply with the Law and Regulations.

Personal data will be processed by Jacques Remy & Fils in accordance with the purposes set out below, via :

Purpose of personal data processing

In accordance with Article 13 of the Regulation, the purposes of personal data processing are communicated to the User and are as follows :

  • to call you or send you information by email that we believe is of legitimate interest to you or that you have requested ;
  • to respond to your requests for information or to process orders you have placed
    for business purposes, such as data analysis, audits, fraud monitoring and prevention, identifying usage trends, and enhancing, improving, or modifying our services ;
  • When we deem it necessary or appropriate: (1) under applicable law; (2) to comply with legal process; (3) to respond to requests from public and governmental authorities; (4) to enforce our terms and conditions; (5) to protect our business; (6) to protect our rights, privacy, safety, or property and/or that of others; and (7) to allow us to pursue available remedies or limit the damages we may sustain.

Personal data that may be processed

When visiting and using the Website, the User consents to Jacques Remy & Fils collecting and processing the following personal data in accordance with the terms and principles described in this Privacy Policy :

  • All personal data that you have provided to us on a consensual or contractual basis, such as your name, billing and delivery address, telephone number, email address, and payment details.
  • Personal data that will help us contact you in the future, such as your name, company name, address, phone number, and email address, because we believe there is a legitimate interest for both parties.
  • Personal data contained in contact forms and online surveys that you complete, records of our correspondence and telephone calls, and any other instances where you send, receive, or exchange messages in connection with our services.

For example, browsers, operating systems, and devices used to access our content, details about the countries, cities, and languages in which our services are accessed, and information about how and when our services are accessed. DiscoVR’s purpose in collecting this non-personal data is to better understand how visitors to DiscoVR use the website.
  • We and third-party providers may also collect information about your visit to our website. This may include your location, browser and device type, the pages you viewed, the length of your visit, and the search terms you used.

Consent

By accessing and using the Site, the User declares that they have read and freely, specifically, knowingly, and unequivocally agreed to the processing of their personal data. This agreement covers the content of this Privacy Policy.

Consent is given by the positive act of the user checking the box proposing the Privacy Policy via a hyperlink. This consent is a prerequisite for performing certain operations on the Site or for allowing the User to enter into a contractual relationship with Jacques Remy & Fils. Any contract between Jacques Remy & Fils and a User relating to the services and goods offered on the Site is subject to the User’s acceptance of the Privacy Policy.

The User consents to the Data Controller processing and collecting, in accordance with the terms and principles set out in this Privacy Policy, their personal data that they provide on the Website or when using the services offered by Jacques Remy & Fils, for the purposes indicated above.

The User has the right to withdraw their consent at any time. Withdrawal of consent does not compromise the lawfulness of processing based on consent given prior to withdrawal.

Retention period for Users’ personal data

In accordance with Article 13 §2 of the Regulation and the Law, the Data Controller shall only retain personal data for as long as is reasonably necessary to fulfill the purposes for which it is processed.

This period shall in all cases be less than: 3 months.

Recipients of data and disclosure to third parties

Personal data may be transmitted to employees, collaborators, subcontractors, or suppliers of Jacques Remy & Fils who offer adequate data security guarantees and who collaborate with Jacques Remy & Fils in the context of marketing products or providing services. They act under the direct authority of Jacques Remy & Fils and are responsible for collecting, processing, or subcontracting this data.

In all cases, the recipients of the data and those to whom this data has been disclosed comply with the content of this Privacy Policy. Jacques Remy & Fils ensures that they will process this data solely for the intended purposes, in a discreet and secure manner.

User Rights

Users may exercise their rights at any time by sending an email to the following address: administration@jacquesremy.com, or by sending a letter by post, enclosing a copy of their identity card, to the following address: Rue d’Edimbourg 70, 6040 Jumet.

Right of access

In accordance with Article 15 of the Regulation, Jacques Remy & Fils guarantees the User the right to access their personal data. The User has the right to obtain access to said personal data as well as the following information :

  • the purposes of the processing ;
  • the categories of personal data concerned ;
  • the recipients or categories of recipients to whom the personal data have been or will be disclosed, in particular recipients who are established in third countries or international organizations ;
  • where possible, the envisaged period for which the personal data will be stored, or, if not possible, the criteria used to determine that period ;
  • the existence of automated decision-making, including profiling, referred to in Article 22(1) and (4) of the Regulation, and, at least in those cases, meaningful information about the logic involved, as well as the significance and the envisaged consequences of such processing for the data subject.

The Data Controller may charge a reasonable fee based on administrative costs for any additional copies requested by the User.

When the User submits this request electronically (e.g., via email), the information is provided in a commonly used electronic format, unless the User requests otherwise.

A copy of this data will be provided to the User no later than one month after receipt of the request.

Right of rectification

Jacques Remy & Fils guarantees the User’s right to rectify and erase personal data.

In accordance with Article 16 of the Regulation, incorrect, inaccurate, or irrelevant data may be corrected or erased at any time. The User must first make the necessary changes themselves from their user account/other, unless these cannot be done independently, in which case the request can be made to administration@jacquesremy.com

In accordance with Article 19 of the Regulation, the Data Controller shall notify each recipient to whom the personal data have been disclosed of any rectification of the personal data, unless such communication proves impossible or requires disproportionate effort. The Data Controller shall provide the data subject with information on these recipients if the data subject so requests.

Right to erasure

The User has the right to obtain the erasure of their personal data as soon as possible in the cases listed in Article 17 of the Regulation.

Where the Data Controller has made the personal data public and is obliged to erase it pursuant to the preceding paragraph, the Controller, taking into account available technologies and implementation costs, shall take reasonable steps, including technical measures, to inform other Controllers who process such personal data that the data subject has requested the erasure by such Controllers of any links to, or copies or reproductions of, such personal data.

The two preceding paragraphs shall not apply to the extent that such processing is necessary :

  • for exercising the right of freedom of expression and information ;
  • to comply with a legal obligation which requires processing under Union law or the law of the Member State to which the controller is subject, or to perform a task carried out in the public interest or in the exercise of official authority vested in the controller;
  • for the establishment, exercise, or defense of legal claims.

In accordance with Article 19 of the Regulation, the controller shall notify each recipient to whom the personal data have been disclosed of any erasure of personal data or any restriction of processing carried out, unless such communication proves impossible or involves disproportionate effort. The controller shall provide the data subject with information on these recipients if the data subject requests it.

Right to restrict processing

The User has the right to obtain the restriction of the processing of their personal data in the cases listed in Article 19 of the Regulation.

In accordance with Article 19 of the Regulation, the Data Controller shall notify each recipient to whom the personal data have been disclosed of any restriction of processing, unless such communication proves impossible or involves disproportionate effort. The Data Controller shall provide the data subject with information on these recipients if the data subject so requests.

Right to data portability

In accordance with Article 20 of the Regulation, Users have the right to receive from Jacques Remy & Fils personal data concerning them in a structured, commonly used, and machine-readable format. Users have the right to transmit this data to another data controller without Jacques Remy & Fils obstructing this in the cases provided for by the Regulation.

When Users exercise their right to data portability in accordance with the previous paragraph, they have the right to have personal data transmitted directly from one data controller to another, where technically feasible.

The exercise of the right to data portability is without prejudice to the right to erasure. This right does not apply to processing necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller.

The right to data portability does not affect the rights and freedoms of third parties.

Right to object and automated individual decision-making

The User has the right to object at any time to the processing of their personal data on grounds relating to their particular situation, including the automation of data carried out by Jacques Remy & Fils. In accordance with Article 21 of the Regulation, Jacques Remy & Fils will no longer process personal data unless there are legitimate and compelling reasons for the processing that override the interests and rights and freedoms of the User, or for the establishment, exercise, or defense of legal claims.

Where personal data are processed for marketing purposes, the User has the right to object at any time to the processing of personal data concerning him or her for such marketing purposes, including profiling to the extent that it is related to such marketing.

When the data subject objects to processing for marketing purposes, the personal data shall no longer be processed for such purposes.

Right to lodge a complaint

Users have the right to lodge a complaint regarding the processing of their personal data by Jacques Remy & Fils with the Data Protection Authority,

Limitation of liability of the Data Controller

The website may contain links to other websites owned by third parties not affiliated with Jacques Remy & Fils. Jacques Remy & Fils is not responsible for the content of these websites or their compliance with the Law and Regulations.

The holder of parental authority must give their express consent for minors under the age of 16 to disclose personal information or data on the website. Jacques Remy & Fils strongly advises persons exercising parental authority over minors to promote responsible and safe use of the Internet. The Data Controller cannot be held liable for collecting and processing personal information and data from minors under the age of 16 whose consent is not effectively covered by that of their legal parents, or for incorrect data—particularly regarding age—entered by minors. Under no circumstances will personal data be processed by the Data Controller if the User specifies that they are under the age of 16.

Jacques Remy & Fils is not responsible for the loss, corruption, or theft of personal data caused in particular by the presence of viruses or as a result of cyber attacks.

Applicable law and competent jurisdiction

This Privacy Policy is governed exclusively by Belgian law. Any dispute shall be brought before the courts of the judicial district of Charleroi, where the company’s registered office is located.
